David Roberts, Intellectual Property Attorney: One of the biggest mistakes that companies make with respect to their management strategy is the complete lack of a strategy overall. Many companies feel that they’ve invested a lot of money into acquiring the patent and therefore they need to continue to pay the maintenance fees, and that’s their management strategy. Really there can also be a lot of emotion involved, or sometimes even company politics as to whether a particular asset is maintained.
The key question that someone needs to answer is whether or not there is an identifiable revenue or an identifiable business strategy attached to maintaining each asset within the portfolio.
